Tax mistakes, even small ones, can sometimes lead to massive losses. This is what happened to Seema, who found herself staring at a tax notice of Rs 2.58 crore after selling a piece of land in Patna. The confusion arose due to a simple error in her tax return.
In a LinkedIn post shared by TaxBuddy, it mentioned that Seema had sold her land for Rs 2.87 crore and purchased a house in Delhi for Rs 2.62 crore.
She was eligible for tax exemption under section 54F, which applies when capital gains from the sale of any asset are invested in a residential house. However, in her tax return, she mistakenly claimed exemption under section 54, which is meant for gains from the sale of a residential house.
The assessing officer rejected her claim, stating that land does not qualify under section 54. Since she had not correctly claimed section 54F in her return, the entire long-term capital gain of Rs 2.58 crore was taxed. Her total income jumped from Rs 21 lakh to Rs 2.79 crore, creating a huge liability.
Seema then appealed to the Commissioner of Income Tax (Appeals), but the CIT(A) agreed with the AO, stating that she had not proved the conditions for section 54F. The authorities also ignored CBDT Circular No. 14/1955, which instructs officers to support taxpayers in claiming lawful exemptions instead of penalising them for minor errors.
At the Income Tax Appellate Tribunal (ITAT), Seema’s counsel presented sale and purchase deeds showing she had indeed invested in a residential house and met all conditions under section 54F. They also cited CBDT Circular 14/1955, which emphasises fairness over technical mistakes.
The ITAT ruled that claiming the wrong section in the return should not prevent a taxpayer from getting exemptions they are entitled to. Guided by the circular, the Tribunal allowed Seema to claim the exemption under section 54F, saving her Rs 2.58 crore.
This case highlights the importance of accuracy in tax filings and also shows that minor mistakes need not always result in huge losses if taxpayers know their rights and the legal provisions protecting them.
